Trademarks can be registered in the United States in any one of the following ways:

• An applicant who is currently using the mark in interstate commerce or in commerce between the United States and a foreign country may file an application;
• An applicant who is not currently using the mark in commerce but who has a bona fide intent to use the mark in commerce may file an application based on that intent to use; or
• An applicant who has made an application or has a registration in a country that is a member of the Paris Convention may file a United States application based on that application or registration.
